1. About Us
Hail Dent Repair Pty Ltd (“Hail Dent Repair”, “we”, “us”, “our”) operates as a referral and booking platform that connects vehicle owners (“Customer”, “you”) with independent Paintless Dent Repair (PDR) technicians (“Technician”, “Contractor”). We are not a repair service provider. We act solely as an agent facilitating the connection between Customers and independent Contractors.
2. Nature of Service
Hail Dent Repair provides a technology platform for job intake, quoting, scheduling, dispatch, and payment processing for PDR services. All repair work is performed by independent contractors who are not employees, agents, or representatives of Hail Dent Repair. Hail Dent Repair does not perform, supervise, direct, or control any repair work carried out on your vehicle.
3. Limitation of Liability — Workmanship
IMPORTANT: By accepting these terms, you acknowledge and agree that:
Hail Dent Repair is not responsible for the quality, standard, or outcome of any repair work performed on your vehicle. All workmanship is the sole responsibility of the independent Contractor assigned to your job.
Any warranty, guarantee, or assurance regarding the quality of repair work is between you and the Contractor directly. Hail Dent Repair makes no representations or warranties, express or implied, regarding the Contractor’s workmanship, skill, or fitness for purpose.
To the maximum extent permitted by the Australian Consumer Law (Competition and Consumer Act 2010 (Cth), Schedule 2), Hail Dent Repair excludes all liability for any loss, damage, cost, or expense arising from or in connection with the repair work, including but not limited to: damage to your vehicle caused during the repair process; defective, incomplete, or unsatisfactory workmanship; delays in completing the repair; any consequential, indirect, or economic loss.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee or right that cannot be excluded under the Australian Consumer Law. However, you acknowledge that to the extent any such guarantees apply to Hail Dent Repair, our liability is limited to re-supplying the referral service or paying the cost of having the referral service re-supplied.
4. Disputes Regarding Workmanship
If you are dissatisfied with the quality of repair work, your claim is against the Contractor, not Hail Dent Repair. Hail Dent Repair may, at its sole discretion, assist in facilitating communication between you and the Contractor to resolve disputes, but is under no obligation to do so. You may also seek resolution through applicable consumer protection bodies such as NSW Fair Trading.
5. Payment Terms
Payment for repair services is due upon completion of the work, unless otherwise agreed in writing. Payments are processed securely via Stripe. Hail Dent Repair collects payment on behalf of the Contractor and remits the Contractor’s portion after deducting its service fee. All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.
6. Referral Program
Hail Dent Repair may offer a referral program where existing customers can earn a $20 credit for referring new customers whose jobs are completed and paid. Referral credits are subject to the terms of the referral program as published on our website and may be amended or discontinued at any time.
7. Privacy
We collect and handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Your information may be shared with the assigned Contractor solely for the purpose of performing the repair service.
8. General
These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect. Hail Dent Repair reserves the right to update these terms at any time. Continued use of our services constitutes acceptance of the updated terms.
